Navient Is Sued by Student Loan Consumer

A Minnesota consumer sued Navient in April 2017 for allegedly violating the Fair Debt Collection Practices Act by misrepresenting the status of her student loan debt. The complaint states that after the plaintiff had settled her account, she received a notification threatening to withhold her wages should she fail to set up a repayment agreement and was subsequently notified that an administrative wage garnishment had commenced. The complaint further alleges that Delta Management Associates, a debt collection agency, failed to send the plaintiff a notice of proposed garnishment before instructing her employer to withhold wages and failed to allow her to inspect and copy records pertaining to her debt and enter into a written repayment agreement.
