Robbins LLP is Investigating Price Fixing Allegations Against Major Chemical Companies

Robbins LLP is investigating the allegations that Covestro AG, Covestro LLC, BASF SE, BASF Corp., Dow Chemical Company, Huntsman International, Wanhua Chemical Group Co., Ltd., and Wanhua Chemical engaged in a conspiracy to fix, raise, maintain, or stabilize prices and to allocate customers and markets for two chemicals - methylene diphenyl diisocyante (MDI) and toluene diisocyante (TDI).  These chemicals are used in virtually every type of foam, i.e., for appliances, furniture, mattresses, carpet underlay, packaging, home insulation, and mobile seating, as well as other applications, such as the manufacture of coatings, sealants, adhesives, and elastomers.  For approximately ten years before the conspiracy, the prices of MDI and TDI remained relatively stable.  Then, prices suddenly shot up and have doubled since 2015.  The price increase cannot be explained by increases in the price of raw materials, energy, or other relevant factors. The conspiracy has resulted in consumers paying artificially inflated prices for these chemicals.  Notably, the United States Department of Justice is conducting a criminal investigation into the market for MDI, and has issued subpoenas at Covestro and BASF Corp.
